Charged With An Ounce Of Cocaine: Client Gets Drug Diversion Program

drug diversion prigramThe client is stopped in Jamestown, RI for a traffic offense. After a check on the client’s license, it comes back as suspended.  An inventory search of the car reveals an ounce of cocaine. The client is charged with possession of an ounce to a kilogram of cocaine. If convicted, the client could face up to life in prison. After he is arrested, the client hires RI Drug Lawyer Noah Kilroy to represent him.

Rhode Island General Laws 21-28-4.01 provides in pertinent part that:

“Any person who is not a drug-addicted person, as defined in § 21-28-1.02(18), who violates this subsection with respect to a controlled substance classified in schedule I or II, except the substance classified as marijuana, is guilty of a crime and, upon conviction, may be imprisoned to a term up to life or fined not more than five hundred thousand dollars ($500,000) nor less than ten thousand dollars ($10,000), or both”

After Attorney Kilroy is able to investigate this case, he discovers that there are problems with the evidence against the client. After these evidentiary issues are raised to the State and judge, the client is given the option to participate in the RI Drug Diversion program.  This program is designed to address the substance abuse needs of alleged offenders in exchange for lighter penalties than the individual would receive in court normally.
